Often the best way to avoid litigation is to implement fair, objective, and consistent decision making processes. Proactive measures designed to avoid or minimize the effects of litigation can be achieved by creating defensible comprehensive plans, an inclusive and informed decision making process, and by ensuring predictability in development review. This essential program will break down some of the most difficult questions that arise when confronted with difficult or litigation prone planning and zoning decisions, and provide attendees with solutions. Topics include: how to identify a conflict of interest; how to review a rezoning request; how to apply discretionary standards during special land use reviews; reasonable expectations of a developer; and how your master plan can minimize risk.
